Legal expert, Ulrich Roux says that this could simply be a ploy to delay the corruption trial which has been in the making for the last 16 years.

Zuma is accusing Downer of leaking his medical records.

Roux said, "we need to look at the history of this matter and how far it has come and how many years this has been in the making since 2005 so 16-years in the making.

"There have been so many applications launched on behalf of Jacob Zuma which has caused a delay in this matter and I think that is clearly a strategy.

"His legal team has advised him about the numerous ways one could delay a criminal trial from proceeding and coming to fruition and they are exploring every single possibility.

"I do think if a criminal charge is laid against Billy Downer and there are merits in the criminal charge and the NPA indicates that they will be prosecuting him, that could make a strong case for Judge Koen to make a ruling that he should be recused from the matter and be replaced by a different prosecutor."
