JOHANNESBURG - The Constitutional Court dismissed Public Protector Busisiwe Mkhwebane’s bid to appeal the ruling on the Estina dairy farm matter.

The judgment in Pretoria by High court judge Ronel Tolmay had invalidated her report implicating the controversial Gupta family.

Tolmay said the Public Protector's conduct during the entire investigation constitutes gross negligence.

The Constitutional Court has now found that her application to challenge the verdict had no reasonable prospect of success.

The Democratic Alliance has welcomed the court's decision, saying Mkhwebane has exhausted all avenues to delay holding senior politicians involved in the controversial project to account.
