File: Public Protector Busisiwe Mkhwebane says the rules Parliament adopted last year for the removal of the head of a Chapter 9 Institution, are unconstitutional.
JOHANNESBURG - Public Protector Busisiwe Mkhwebane says it amounts to a violation of the constitutionally prescribed duty imposed on organs of state to protect the independence of Chapter 9 institutions.
Mkhwebane made the remarks at a media briefing on Tuesday.
Speaker of Parliament Thandi Modise recently approved a motion by the DA to consider Mkhwebane’s removal.
Mkhwebane says she hopes for an amicable solution, failing which she will institute a legal challenge against Modise.
