JOHANNESBURG - Another report by the Public Protector has been overturned.

The High Court in Pretoria has ruled her findings on the protection of whistleblowers invalid and must be set aside.

Busisiwe Mkhwebane found that Police Minister Bheki Cele had failed in his duties by not providing the protection.

Two whistleblowers -- Les Stuta and Thabiso Zulu -- exposed wrongdoing in the Umzimkhulu municipality in KwaZulu-Natal.

They also had links to Sindiso Magaqa, who was murdered allegedly after handing over incriminating documents to the Hawks

Mkhwebane had found the SAPS should have provided the protection they sought.

The court agreed with Cele that this is the responsibility of the Justice Department.

Cele is welcoming the ruling.

In a scathing statement, he says the overturning of the Public Protector's reports is becoming too familiar a sight, saying she should have known better.
