eTV can appeal unencrypted digital TV ruling: judge

JOHANNESBURG - eTV is again taking the communications ministry to court over the digital television migration policy.

The broadcaster has been granted leave to appeal an earlier ruling which allowed the communications minister to implement unencrypted digital TV.

If the digital transmissions are unencrypted, eTV won&39;t be able to protect its content, making it easily susceptible to piracy.

The High Court ruled against the broadcaster&39;s application to overturn Faith Muthambi&39;s decision early this year.

Now Judge Bill Prinsloo says  the case can go to the Supreme Court of Appeal.

A section of the law on this issue has been changed and can be challenged.
