Judge Masipa turns down Pistorius appeal decision

JOHANNESBURG – Judge Thokozile Masipa has ruled against Oscar Pistorius&39;s legal team, saying her court was not the correct forum for an appeal to be heard.

Masipa gave her ruling after less than an hour of argument this morning. 

The Pistorius legal team had gone to court to appeal a previous decision which Masipa had made granting the prosecution leave to appeal her culpable homicide conviction of the Paralympian.

"I am not satisfied that this is the correct court to hear this application. For one thing there is really nothing new in this application," she said. 

Her ruling means that the case will now go to the Supreme Court of Appeal, where five judges will hear the State&39;s appeal.

Pistorius was convicted of culpable homicide in September last year for killing his girlfriend Reeva Steenkamp. In December, Judge Masipa granted the State leave to appeal.
