Oscar Pistorius leaves the North Gauteng High Court in Pretoria after the judge ordered that he should undergo mental evaluation on May 14, 2014.

JOHANNESBURG – Oscar Pistorius is right to appeal his murder conviction in the Constitutional Court, and his chances are good of having it declared unfair, defence attorney Chrispen Machingura has told eNCA.

Machingura – who is not part of the Paralympian&39;s defence team – said he believed it was correct to accuse the Supreme Court of Appeals judges of having considered aspects of the evidence rather than keeping to their jurisdiction of considering only the legal findings of Judge Thokozile Masipa.

Machingura said this might constitute grounds for an unfair conviction, as Pistorius&39;s lawyers would now argue in the Constitutional Court.

Machingura said he did not expect the matter to come before the Constitutional Court in the first half of the year, at least.
