JOHANNESBURG – Newly-reinstated senior official Jonas Makwakwa is still under investigation for tax offences, SA Revenue Service (SARS) commissioner Tom Moyane admitted on Tuesday.

Moyane says Makwakwa is being probed by the very same tax authority he is meant to lead.

The commissioner said he could not answer questions about how SARS could justify this because doing so could violate Makwakwa’s right to confidentiality as a taxpayer.

“The Tax Administration Act is clear, we treat Makwakwa as a taxpayer and therefore, if I am going to violate the very Tax Administration Act that was enacted by Parliament, then I will be violating the very principle for which we stand,” Moyane told Parliament&39;s standing committee on finance on Tuesday.

Makwakwa was suspended in September 2016 over alleged irregular payments into his account and that of his girlfriend, Kelly-Ann Elskie.
