JOHANNESBURG - The Constitutional Court will hand down a judgment that may change the parental leave policy.
It will rule on the constitutionality of provisions of the Basic Conditions of Employment Act related to maternity and paternity leave.
In 2023, the Gauteng High Court in Johannesburg ruled that certain sections regarding maternity leave violated constitutional rights.
In its current form, the Act allows biological mothers to get four months of paid leave, while fathers get 10 days.
The court proposed that both parents are entitled to four months of paid leave.
