Defence denies Sibiya was arrested at strip club

JOHANNESBURG - Suspended Deputy National Police Commissioner Shadrack Sibiya is disputing where he was arrested in connection with allegations of sexual grooming and rape.

Sibiya’s lawyers argue that he was arrested at a restaurant near The Grand in Sandton, rather than inside the strip club.

But investigating officer Nokukhanya Ndlovu was adamant under cross-examination that she arrested Sibiya at the strip club.

“Upon the arrest of the applicant, you were present at The Grand,” Sibiya’s lawyer, Advocate Amanda Nel, put to Ndlovu.

“I am the one who effected the arrest at the strip club at The Grand,” Ndlovu responded.

Sibiya was arrested on 21 September. 

Nel pressed Ndlovu to clarify exactly where the arrest took place, asking whether it was at the strip club, restaurant or hotel section of the building.

“I love it how you repeat ‘strip club’. I put it to you; it’s not exclusively a strip club. There is a restaurant area and there is a hotel area, those areas are separate from the strip club. Are you going to dispute that?" Nel said.

“He was not at the hotel side. He was not at the restaurant side. He was at the strip club. When you enter, the strip club is right at the entrance, and that is where I effected the arrest,” Ndlovu told the court.

But Nel said according to Sibiya, he was arrested at the restaurant area in the company of three other men.

The dispute over the precise location of Sibiya’s arrest forms part of his legal challenge as the bail application continues.
