Feroz Khan set to appeal Labour Court ruling

JOHANNESBURG - Suspended Crime Intelligence deputy head Major-General Feroz Khan is expected to appeal the Labour Court ruling.

The ruling allows the SAPS to continue with a disciplinary process that recommends that he be dismissed.

But Khan’s legal team, led by Muhammed Valley, argues that the disciplinary process against their client is prejudicial.

“Difficult circumstances, given our client’s personal condition. We believe that there’s still merit that can be argued before a future court because the Labour Court decided the matter on a legal technicality or legal technical point,” Valley said.

He further argued that the merits of the case are not yet “dead” and that they could re-enrol the matter in future or approach a different forum for similar or the same relief.

“Our client was unable to defend himself. And because of that, we felt obliged to step into the position where we protect him as his lawyers. We simply couldn’t allow the process to proceed unchallenged. And the outcome is as the outcome is, but there’s, like I said, scope for taking the matter further.”
