JOHANNESBURG - Disgraced top cop Shadrack Sibiya has denied all the charges against him, saying they are false and trumped up.
Sibiya, who is applying for bail in the Randburg Magistrate’s Court, faces five charges, including the alleged rape of an 18-year-old, the sexual grooming of a 16-year-old and human trafficking.
In his affidavit, Sibiya told the court that he intended to plead not guilty to all the charges.
He said he first interacted with the 16-year-old, referred to in his affidavit as “ZM”, after her father contacted him about explicit videos of the minor performing sexual acts on herself. The father was Sibiya's protector at the time.
According to Sibiya, the father also told him that the teenager had a crush on him.
The top cop said he continued contacting the teenager to establish why her father had the explicit videos.
He claimed the teenager, who was surprised to learn that her father had the videos, continued sending him more videos so that he could investigate how her father had obtained them.
Sibiya also conceded that he had met the 18-year-old, referred to as “MC”, and later took her out to dinner. However, he said they had consensual sex and that their conversations continued afterwards.
He denied raping her. The state has alleged Sibiya plied the teenager with alcohol before raping her at a Sandton hotel.
In pleading for his release on bail, Sibiya described the plan to arrest him as “diabolical”, claiming there had been a ploy to have him arrested.
A key part of his bail application is that he is due to attend a SAPS disciplinary hearing from 6 to 9 November. He told the court he needs to be released so he can legally prepare for the proceedings.
The bail hearing has been postponed to 1 October. Sibiya remains in custody.
