Another trial-within-a-trial looms in Meyiwa murder case

JOHANNESBURG - Another trial-within-a-trial may be on the cards in the Senzo Meyiwa murder case.

This time, to determine the admissibility of a disputed statement Sifiso Gwabini Zungu allegedly made.

Police claim he hosted the accused at a Vosloorus hostel on the day Meyiwa was killed.

Zungu's alleged statement corroborates Muzi Sibiya and Bongani Ntanzi's confessions and star witness, Constable Sizwe Zungu's testimony.

The court has ruled that the statement's authenticity must be proven before the state's cross-examination continues.

Gwabini is the man police and his uncle, state witness Sizwe Zungu, claim hosted all the accused at a gathering at a Vosloorus hostel on the day Meyiwa was killed.

But he denies ever making a statement.

And like his brother Muzi Sibiya, he claims police tortured him into signing one.

State prosecutor Advocate George Baloyi said: “The only practical way of dealing with this issue is in a trial within a trial in other words Brig Gininda is recalled and the circumstances relating to the taking of the statement are properly ventilated but for that we need to file heads of arguments and this is where we are going with the matter my Lord.”

Legal experts agree.

Arguments have been set down for Tuesday, with a ruling also expected.

If the previous trial-within-a-trial is anything to go by, this process could drag on for months.
