JOHANNESBURG - The Constitutional Court will hear a landmark case that could significantly affect how sexual offences are prosecuted in South Africa.
Organisations fighting against gender-based violence are petitioning the Apex Court to confirm a North Gauteng High Court ruling.
The Court ruled that certain provisions of the Sexual Offences Act are unconstitutional as they compromise victims and survivors of rape.
In its current form, the Act allows perpetrators to avoid conviction if they can prove they believed there was consent.
