Brown Mogotsi to appeal bail refusal

JOHANNESBURG - The Johannesburg Magistrate's Court has once again denied bail to alleged political fixer Brown Mogotsi.

Despite the setback, Mogotsi is continuing his quest for freedom and intends to appeal the decision in the High Court. 

Magistrate Annalise Tlhapi said Mogotsi provided no new facts in his bid for freedom. The court found that the addresses presented by Mogotsi were not new evidence.

The North West businessman has been in custody since his arrest on 15 May.

“We are definitely going to be appealing this decision," said his legal representative, Makau William Sekgatja. 

"We are very disappointed with the decision. We believe that we placed all the necessary evidence for the magistrate to make an informed decision. Our client wants to be free so he can properly prepare for this case."

Sekgatja raised concerns that Mogotsi might face further implications at the ongoing Madlanga Commission. 

He argued that custody complicates legal consultations and would make it difficult for Mogotsi to appear before the commission.

The defence lawyer also firmly denied allegations that Mogotsi had intimidated state witnesses.

Mogotsi faces a string of Schedule 5 offences stemming from an incident in November 2025, where he allegedly faked an assassination attempt on his own life in Vosloorus.

His charges include:

  • Perjury
  • Defeating the ends of justice
  • Unlawful possession of a firearm and ammunition
  • Discharging a firearm in public
  • Attempting to bribe an investigating officer

State prosecutors revealed that ballistic reports link the weapon used in the staged shooting to other serious crimes, including murder. The firearm itself has not yet been recovered.
