EFF, Malema take on firearm case prosecutor

JOHANNESBURG - The EFF and its leader Julius Malema have filed a formal complaint with the National Prosecuting Authority (NPA) against prosecuting state advocate Joel Cesar over alleged misconduct in the East London firearm case. 

The party claims Cesar acted unlawfully by authorising the return of a firearm without a court order.

It describes this as a violation of the Criminal Procedure Act and an overreach of his authority.

The EFF also alleges breaches of the NPA Act and its code of conduct.

Cesar prosecuted Malema in his firearm case, resulting in a five-year direct sentence after his conviction.
