PRETORIA - The Gauteng High Court in Pretoria has dismissed businessman Hangwani Maumela’s urgent application to prevent the sale of his Ferrari.
Maumela and the trustees of the MHR Maumela Family Trust brought the application to stop the sale of a Ferrari SF90 Stradale, valued at at least R9.5 million.
The luxury car is among the assets preserved by the Special Tribunal as part of the Special Investigating Unit’s investigation into alleged corruption and maladministration at Tembisa Hospital, where about R2 billion was looted.
The High Court found that the Tribunal’s order authorising the sale of the vehicle was an interim order and was therefore not automatically suspended by the appeal process.
The court held that Maumela and the trust had failed to establish a clear right to prevent the sale.
It also found that they had failed to demonstrate reasonable prospects of success on appeal or to prove that they would suffer irreparable harm if the sale went ahead.
The court ordered the trustees of the MHR Maumela Family Trust, in their representative capacities, to pay the costs of the application.
