IDAC faces scrutiny over Section 27 referrals at Madlanga Commission

PRETORIA - Investigative Directorate Against Corruption (IDAC) senior investigator Brian Padayachee has told the Madlanga Commission that he has no insight into how Section 27 complaints are issued, as the directorate faces scrutiny over its handling of such referrals.

Padayachee said complainants initiate the process by submitting affidavits directly to the head of IDAC, but he is not involved at that stage and cannot say whether the same procedure applies to other investigators.

He testified that investigators rely on guidance from senior management and only begin work once matters have been authorised.

"With regards to Section 27, when it comes, it goes to the head of the office. The head of the office and management deal with it. They are legally minded in terms of the Act. By the time it comes down to our level, it's already authorised. That's our authority to proceed, and we comply."

Earlier this week, Padayachee testified that the investigation into Divisional Crime Intelligence head Dumisani Khumalo originated from a Section 27 referral under the NPA Act submitted by Member of Parliament Fadiel Adams.
