Kwaggafontein state prosecutor meets Mpumalanga prosecutions head

JOHANNESBURG - Kwaggafontein prosecutor Mkhuseli Ntaba has met with the Mpumalanga head of Public Prosecutions. 

Ntaba has a warrant of arrest against him after it was ruled that he was in contempt of court.

The prosecutor failed to appear in the matter involving Mpumalanga taxi boss Joe "Ferrari" Sibanyoni, Bafana Sindane and two others.

He had told the magistrate on Friday that he could not appear in court on Monday as he had a prior commitment. 

Despite this, the magistrate ordered him to appear.

The matter was struck off the court roll.

The magistrate alleged that there was an unreasonable delay, making it difficult for the matter to proceed.

The NPA head of legal services, Advocate Mthunzi Mhaga, said they will be studying the order to strike the matter off the court roll. 

"We have great difficulty with the order that was made," said spokesperson Adv Mthunzi Mhaga.

"Hence, we are reflecting to determine whether it was the only permissible mechanism on how this matter could have been dealt with," he said.

Sibanyoni, Sindane and the two co-accused were arrested on charges of extortion and money laundering. 

Spokesperson Kaiser Kganyago says a report will be sent to the National Director of Public Prosecutions, Adv. Andy Mothibi.

Kganyago says this is the first time such an incident has happened to the NPA since its founding in 1998.

The authority is working to re-enroll the matter back onto the court roll.
