'Stay in your lane': Adv Dali Mpofu tells WC High Court

CAPE TOWN - MK Party's legal team has said the case before the Western Cape High Court is about more than just the merits of President Cyril Ramaphosa's impeachment process.

It argued the court must first decide whether it should intervene in a matter that is already governed by Constitutional Court rulings.

The President's application to halt Parliament's impeachment process enters its second day in the Western Cape High Court on Thursday.

MK Party lawyer Dali Mpofu argued that the Constitutional Court has already set clear requirements for challenging such a process. 

He said Ramaphosa's legal team had failed to show any evidence of bad faith, or mala fides, as required by those rulings.

Mpofu told the court it should "stay in its lane" and avoid interfering with matters already determined by the Constitutional Court. 

He argued that if the President is dissatisfied with the process, the appropriate forum is the Constitutional Court in Braamfontein, not the High Court.

"With the greatest respect, this court must return a decision that says all this is all very interesting, but we choose to stay in our lane and we are not going to annoy the Constitutional Court in the process of staying in our lane. If you have a problem, go to Braamfontein."
