JOHANNESBURG - Deputy Crime Intelligence head Feroz Khan's urgent application to have his seized devices returned has been struck off the roll.
The matter was heard in the Gauteng High Court in Johannesburg on Friday.
Khan argued the devices contain information on undercover operations, political killings, and gang violence investigations.
He warned unrestricted access could compromise national security and put lives at risk. But in their answering affidavit, the police said Khan did not have clearance since 2023 to deal with any high level matters.
SAPS also argued that the application was now moot as these devices were no longer in the possession of the police as they had been handed over to the Madlanga Commission.
Khan will now have to bring an application against the Commission to have the devices returned to him.
He was arrested for the alleged unlawful possession of unprocessed gold.
He argued police conducted an unlawful and unconstitutional warrantless search of his residence.
During that operation, electronic devices, firearms, and ammunition were seized.
