Will Mapisa-Nqakula face trial? High Court expected to deliver ruling

PRETORIA - The Gauteng High Court in Pretoria is expected to deliver judgment on Monday on former National Assembly Speaker Nosiviwe Mapisa-Nqakula’s application for a discharge under Section 174 of the Criminal Procedure Act.

Mapisa-Nqakula is facing corruption allegations linked to claims that she solicited millions of rand in bribes while serving as Defence Minister.

She has consistently denied the allegations.

Her legal team has argued that the State has failed to present sufficient evidence to justify putting her on trial on the corruption charges.

A Section 174 application allows an accused person to seek a discharge at the close of the State’s case where there is insufficient evidence on which they could be convicted.

If the court grants Mapisa-Nqakula’s application, she could be acquitted without being required to present her defence.
