ANC says system glitch claim does not undermine IEC

JOHANNESBURG - The ANC has defended its candidate list dispute at the Constitutional Court.

The party's lawyer Daniel Berger, on Monday, said the ANC is not undermining the Electoral Commission of South Africa (IEC) by raising technical problems with its system.

He further said the case centres on how the Electoral Act and regulations should be interpreted.

“The Commission admits that the ANC called its helpline shortly before the deadline and does not contradict the ANC's account of the call.  Despite that, we have always said that the Commission's account of how the system worked must be accepted in this case.

“And it is simply wrong to suggest that the party should be admonished for explaining that it experienced problems with the system,"he said.

The party is challenging an Electoral Court ruling in favour of the IEC.

The dispute follows the ANC’s failure to submit all its candidates’ names before the deadline for next month’s local government elections, resulting in the exclusion of 181 candidates.

The Electoral Court ruled against the party, while the IEC maintained that no technical glitches had been reported.
