Apex court rules 2023 Gender Equality Commission appointments invalid

JOHANNESBURG - The Constitutional Court has declared the appointment of five Gender Equality Commissioners invalid.

Non-profit organisation Corruption Watch challenged the appointments.

It argued Parliament failed to comply with its obligation to facilitate meaningful public involvement in the process.

In 2022, the Portfolio Committee on Women made recommendations to the President.

He then appointed the CGE chairperson, and four commissioners.

But Corruption Watch argued the process was rushed.

The apex court has since suspended the invalidity for 12 months.

This means the commissioners will remain in place until a constitutionally compliant process is undertaken.

Parliament says it notes the judgment and remains committed to righting its wrongs.
