UPDATE | ConCourt rules that SAHRC directives are not binding

JOHANNESBURG - The Constitutional Court has ruled that South African Human Rights Commission (SAHRC) directives are not binding.

The judgment stems from a 2024 Supreme Court ruling which held that SAHRC directives are not binding.

The Commission had issued directives to a farmer to restore water to labour tenants, but he ignored them.

The SCA found that, unlike the Public Protector, the SAHRC must approach a court to enforce its findings.
