JOHANNESBURG - Alleged hitman Musa Kekana, accused number one in the attempted murder case against Vusimuzi 'Cat' Matlala and four others, claims officers illegally breached his property and ignored his basic constitutional rights.
The allegations emerged during the cross-examination of Police Captain Phimi Sekgobela, who's in the witness box to defend police actions.
Matlala and his co-accused's trial within a trial is underway in the High Court in Johannesburg.
The defence is challenging the admissibility of evidence obtained during Kekana's arrest.
Kekana isn't backing down on his fight to have evidence obtained from his arrest deemed inadmissible.
These include firearms, ammunition, cellphone records and some admissions.
Kekana claims the police forced entry into his home and arrested him without reading him his rights, a severe procedural violation if proven true.
A crucial turning point in the trial within a trial may hinge on Captain Sekgobela’s official pocketbook and his diary entry from the day of the arrest.
The defence is expected to scrutinise these logs to expose potential discrepancies between the captain's written records and his testimony.
