Court orders Gauteng health to tackle oncology backlog

JOHANNESBURG - The courts have ruled in favour of cancer patients in Gauteng, reinforcing their constitutional right to urgent healthcare.

Section27 and the Cancer Alliance have welcomed the urgent judgment.

It orders the Department of Health to immediately address the backlog in radiation oncology treatment.

The court found that delays in providing treatment have caused irreparable harm, including deaths and disease progression.

The ruling makes it clear that government cannot use appeals or legal delays to avoid its constitutional duty to patients.
