BISHO - Eastern Cape High Court found that the University of Fort Hare acted unlawfully in cancelling the enrolment of Premier Oscar Mabuyane from its master’s degree programme.
The court also ordered the University to pay Mabuyane's legal fees.
The Premier registered for the degree in 2021.
The university claimed he lacked the necessary qualifications and had no valid Recognition of Prior Learning assessment on file, which usually substitutes the prerequisite formal qualifications.
Mabuyane was denied a fair chance to explain himself and appeal the process; the university stands by its decision.
