The devastating incident in the Free State claimed three lives, left 40 people injured, and displaced hundreds of families in the Charlesville and Itumeleng townships.
The Ministry of Water and Sanitation says the report cannot be made public at this stage, as it may form part of criminal proceedings.
Andries Nkome, a lawyer representing the affected families, says those responsible including Jagersfontein Developments, the Minister of Water and Sanitation, and the Minister of Mineral Resources have yet to be held accountable.
He says no compensation has been paid out and accused the mine of trying to limit legal representation for victims in an attempt to weaken their case.
