Tafelberg sale declared unlawful

CAPE TOWN - The Constitutional Court has ruled that the sale of the former Tafelberg School site in Sea Point was unlawful.

The Apex Court found that the Western Cape government and the City of Cape Town failed to meet their constitutional duties on providing affordable housing and did not provide meaningful public participation before the sale.

The judgment ends a legal battle that has lasted almost ten years and sets aside an earlier Supreme Court ruling.

The province and the City must now report to the High Court on plans to expand affordable housing and address spatial inequality in central Cape Town.

The ruling is expected to shape how government disposes of public land in the future.
