PRETORIA - The High Court in Pretoria has ruled that the suspension of Road Traffic Management Corporation (RTMC) CEO Advocate Makhosini Msibi was unlawful.
Msibi was suspended on the first of July last year.
The move followed a board meeting in June.
A whistleblower had raised claims of financial misconduct irregular spending and governance failures.

But the court says the board did not have the power to suspend him.
The court found that power must come from the Shareholders Committee in writing.
The court also struck down the board charter saying the board had no authority to adopt it.
However, that ruling is suspended for 90 days to allow the process to be fixed.
