The Western Cape High Court has ruled that his appointment by the National Assembly as a member of the Judicial Service Commission was unconstitutional and invalid.
Last month, the Constitutional Court dismissed the MK Party and Hlophe's application to challenge the interim interdict preventing him from serving on the JSC.
Hlophe was interdicted from JSC processes after a court case brought by the Democratic Alliance, Corruption Watch and Freedom Under Law.
Hlophe was impeached for trying to sway Constitutional Court Justices Chris Jafta and Bess Nkabinde, to rule in favour of former President Jacob Zuma in the arms deal case.
