A full bench of the High Court in Pretoria ruled the matter is not urgent and noted that the commission is already under way.

Additionally the court did not consider the merits of the case as both sides argued on the issue of urgency.

The court found no reason to fast track the matter.

The party approached the High Court to halt the inquiry after the Constitutional Court denied it direct access.

MKP challenged how President Ramaphosa handled Police Minister Senzo Mchunu who was placed on special leave after KZN Police Commissioner Nhlanhla Mkhwanazi's allegations.

The party claimed the President acted in bad faith, was biased, and violated the Constitution.
