JOHANNESBURG - The High Court in Johannesburg declared the Gauteng Health Department's failure to treat nearly 3,000 cancer patients as Unconstitutional and unlawful.
The radiation treatment backlog at Charlotte Maxeke and Steve Biko hospitals has led to irreparable harm, with some patients dying while waiting for treatment.
The court has ordered urgent action, but the department is appealing the ruling, warning it could set an ‘undesirable precedent.’
