JOHANNESBURG - We’re exploring three fundamental values that lie at the heart of a fair and just society: equality, human dignity, and freedom. These are more than just ideals: They are rights protected by South Africa’s Constitution to ensure that everyone is treated fairly and with respect.
Let’s start with equality. Section 9 of the Bill of Rights states that everyone is equal before the law and is entitled to equal protection and benefit of the law. It also allows the state to introduce measures to protect or advance people who have been disadvantaged by unfair discrimination. No one should face unfair discrimination based on factors such as race, gender or disability.
Next is human dignity. Section 10 recognises that everyone has inherent dignity and the right to have that dignity respected and protected. In simple terms, every person has value simply because they are human. Everyone deserves to be treated with respect, regardless of their circumstances or background.
Then there’s freedom and security of the person, protected by Section 12. This right protects people against violence, arbitrary deprivation of freedom and cruel, inhuman or degrading treatment. It also safeguards bodily and psychological integrity, including the right to make decisions about reproduction and security in, and control over, one’s own body.
Together, these rights help create a society where everyone is treated equally, their dignity is respected, and their freedom and safety are protected.
Consider homelessness, for example. These constitutional rights mean that people experiencing homelessness are entitled to the same legal protection as everyone else. Their circumstances do not diminish their dignity, and they have the right to be protected from violence and degrading treatment.
Ultimately, equality, human dignity and freedom are interconnected. Upholding these rights helps build a society where everyone can live with respect, safety and a sense of belonging.
Because a fair society starts with protecting the rights of every person.
