Sibiya slams state, alleges no warrant for seizure of his device

JOHANNESBURG - Suspended Deputy National Commissioner for Crime Detection Shadrack Sibiya has slammed how the state handled the seizure of his cellphone.

The defence has accused the police of seizing his device without a proper search warrant.

The disgraced top cop's lawyer, advocate Amanda Nel, called on the investigating officer to prove that the seizure was legal under the Criminal Procedure Act.

Sibiya's bail hearing continues at the Randburg Magistrate's Court on Friday. 

According to defence, he seeks bail in order to prepare for his disciplinary hearing, scheduled to start on Monday.

He faces several charges, including rape, trafficking, sexual grooming and negligent handling of a firearm. He is accused of the rape of an 18-year-old and the grooming of a 16-year-old minor.

Sibiya challenged the state's narrative regarding explicit images found in the minor's phone. He had previously told the court that the girl's father had sent him a video of her pleasuring herself.

He later sent the video to the girl, who was surprised and allegedly had no knowledge of who recorded it.

Nel enquired whether the teenager had been formally questioned about the video's origin. She also asked whether the father, Sibiya's alleged former protector, was aware of the images and videos.
