Court rules Andile Lungisa’s removal from ANC candidate list 'unlawful'

GQEBERHA - The Johannesburg High Court has ordered the ANC to reinstate Andile Lungisa on its proportional representation (PR) candidates list for the Nelson Mandela Bay Municipality.

The court ruled on Friday that Lungisa’s removal from the list was unlawful, invalid and unconstitutional. 

The ANC NEC member approached the court after his name was removed from the party’s candidate list, denying him the opportunity to contest the 4 November local government elections.

In court papers, Lungisa said he had been nominated by ANC branches in Nelson Mandela Bay, placed at the top of the list and confirmed as the highest-ranked candidate at the provincial list conference.

He was subsequently shortlisted and publicly announced by ANC president Cyril Ramaphosa as the party’s mayoral candidate for the municipality.

However, Lungisa said his name was removed before the list was submitted to the Electoral Commission of South Africa.
