The former major general has repeatedly failed to appear before the inquiry, previously submitting a sick note.
Khan has also been implicated in allegations of wrongdoing being examined by the commission, while his relationship with former IDAC head Andrea Johnson has come under scrutiny.
Meanwhile, an alleged associate of Khan was killed in a shooting in Ekurhuleni last night.
The circumstances surrounding the killing are being investigated, with the incident reportedly being treated as a possible hit.
