PRETORIA - Feroz Khan is still expected to appear before the Madlanga Commission, said spokesperson Jeremy Michaels.
The Commission will be laying criminal charges against him for failing to appear on Monday. Michaels said Khan is still under subpoena and the Commission is not giving up on him yet.

The dismissed police officer was expected to testify before the Commission from Monday. This is after he was implicated by multiple witnesses at the Commission.
Khan was allegedly shot in June and was hospitalised. His legal team has used his health as an excuse why he could not appear before the Commission. However, he has since been discharged.
On Monday, his legal team asked for a postponement, once again, citing his health again.
When asked by Commission Chairperson Mbuyiseli Madlanga if they had made preparations for Khan to be able testify, they said they had no.
Khan's lawyer, Muhammed Vally said they are yet to consult with him on a way forward.
"We will dealt with that in the fullness of time at the appropriate forum," Vally said.
