NPA loses bid to overturn separation of Msiza, Matsepe from VBS trial

JOHANNESBURG - The long-running VBS Mutual Bank saga has suffered another legal setback for the National Prosecuting Authority. 

The Supreme Court of Appeal has dismissed the NPA’s bid to challenge the separation of Danny Msiza and Kabelo Matsepe from their co-accused in the VBS case.

Msiza and Matsepe face charges, including racketeering, theft, fraud and money laundering, linked to the alleged looting of billions of rands from the VBS Mutual Bank.

Their trial was separated from that of their co-accused in 2024, following disputes surrounding delays in the case.

The NPA challenged the decision, hoping to have the proceedings reconsidered. But the Supreme Court of Appeal found that the arguments presented did not meet the required legal requirements and that there were no reasonable prospects of success.

The ruling, however, does not mean Msiza or Matsepe have been cleared of the charges.

The State also retains the option of applying for the trials to be consolidated again, should it believe that doing so is appropriate.
