CAPE TOWN - President Cyril Ramaphosa is well within his rights to seek legal recourse, says legal experts.
Judgment on his urgent application to halt Parliament's Impeachment Committee's proceeding is expected on Friday.
CASAC's Lawson Naidoo says there is no clear line in the separation of powers between the Executive and Legislation.
"The issue here is that the Constitutional Court did not say more, that the report of the independent panel should be referred to the Committee," he adds.
Ramaphosa says the panel has adopted an incorrect interpretation of legal principle. He says relevant evidence has been misconstrued; the independent panel has misdirected itself and has made conclusions that are susceptible to review.
He says the Committee's work should be paused while the validity of the report is being challenged.
The application also casts the spotlight on Parliament’s legislative oversight.
