'Return to work' : NPA head withdraws suspension of persecutor in Joe Sibanyoni case

JOHANNESBURG - The National Director of Public Prosecutions (NDPP) has withdrawn the suspension against Advocate Mkhuseli Ntaba, the prosecutor in the Joe 'Ferrari' Sibanyoni extortion case. 

This was revealed by the National Prosecuting Authority (NPA) in a statement on Wednesday.

Kwaggafontein Chief Magistrate Tuletu Tonjeni had issued a warrant of arrest against Ntaba and convicted him of contempt of court.

This was after Ntaba failed to appear before the court.  Ntaba had previously informed the magistrate that he had a prior commitment and could not make the scheduled date.

According to NPA spokesperson Kaizer Kganyago, the Office for Ethics and Accountability (OEA) on Tuesday submitted an interim report into the circumstances that led to the events that took place regarding the case of Sibanyoni and co-accused.

Upon consideration of the interim report, NDPP Adv Andy Mothibi, in consultation with the Director of Public Prosecutions (DPP), Mpumalanga Division Advocate Sonja Ntuli, directed that the letter of suspension be withdrawn and that he be allowed to return to work.   

"The decision to withdraw the suspension letter is based on the verified version of Ntaba relating to his safety and by the OEA’s view that Ntaba has cooperated with them and that there is no likelihood that he will interfere with the outstanding investigations," he said.
