NPA adamant on re-enrolling Joe 'Ferrari' case

JOHANNESBURG - The National Prosecuting Authority (NPA) is not backing down on the case against prominent taxi boss Joe 'Ferrari' Sibanyoni and his co-accused, which was struck off the roll.

In the latest developments, the NPA has moved to file an application for leave to appeal the contempt of court order and warrant of arrest against the prosecutor, Mkhuseli Ntaba.

Ntaba failed to appear in the bail hearing at the Kwaggafontein Magistrate’s Court.

Speaking to eNCA, NPA spokesperson Kaizer Kganyago said the authority wants the matter to be back on roll so that the accused can be given the opportunity to answer to the charges against him.

This, he said, will allow for justice to be carried out rather than for the accused to get out on a technicality.

“What we are asking from the magistrate are the written reasons for the order, so that we are able to see whether there are further grounds that we can use to deal with this matter,” Kganyago said

The men faced charges of extortion and money laundering.

In a dramatic and highly unexpected turn of events, Sibanyoni, Mvimbi Masilela, Philemon Msiza, and Bafana Oupa Sindane walked out of court as free men on Monday.

Chief Magistrate Tuletu Tonjeni struck the high-profile case off the roll, and a warrant of arrest was issued for the prosecutor.

Kgangago said the National Director of Public Prosecution has already appointed a senior counsel, who is looking into the matter.
