BLOEMFONTEIN - Nandipha Magudumana’s lawyer told the Free State High Court that she can't proceed with the trial.
This, as a Constitutional Court ruling is still pending on her challenge against her deportation from Tanzania.
A case management hearing in the Thabo Bester prison escape case was held online on Friday.
Magudumana is accused of helping Bester escape from prison, where he was serving a life sentence.
Magudamana's lawyer, Machini Motloung, said, "We are not ready to set the matter down for plea and pre-trial, owing to the previous reasons which we advanced to this court with regard to the matter not being trial-ready. The issue at hand is the pending Constitutional Court challenge, which has since taken place."

She said the matter was argued on the 14 of May, 2026, and judgment has been reserved.
"We are awaiting judgment in the matter, and it is our firm view that it would not serve any purpose, and it would actually waste the court's time if we were to arrange a trial date at this juncture whilst awaiting the finalisation of the constitutional court challenge."
