Ramaphosa's Section 89 challenge could trigger constitutional clash, says analyst

JOHANNESBURG - President Cyril Ramaphosa’s bid to have the Section 89 report reviewed has the potential to trigger a constitutional clash between Parliament and the Presidency.

This is according to political analyst Dr Mpumelelo Mkhabela.

Mkhabela says this is the first time the head of the Executive has sought to interdict an ongoing parliamentary process.

"Usually you would take Parliament to court for review, if they have done so, but it must be at the end of the process," says Mkhabela.

Ramaphosa’s urgent bid to halt the impeachment committee proceedings will be heard on Wednesday and Thursday.

The President wants the process suspended pending a review of the Section 89 Independent Panel Report, which found that he has a case to answer regarding the Phala Phala saga.

Parliament established the committee after the Constitutional Court ordered that the impeachment proceedings continue.

"It is unusual for the President to say to Parliament, I am interdicting you, stop what your process," says Mkhabela.

Mkhabela says Ramaphosa may be signalling that, should he succeed in court, Parliament’s impeachment process would ultimately prove wasteful and fruitless.
