PRETORIA - Day 6 of the Madlanga Commission of Inquiry focused on the legislation that governs the South African Police Service.
What came out clearly is that the roles of the police minister and the national police commissioner are clearly defined in law.
Police minister Senzo Mchunu did not have the authority to disband the political killings task team.

Suspended deputy police commissioner Shadrack Sibiya didn't have the powers either to move the 121 dockets being that were being investigated by the task team.
The commission heard expert testimony from SAPS legal head, Marga van Rooyen, on the legislative framework governing the South African Police Service.
Van Rooyen added that by law Mchunu could not freeze vacant posts within crime intelligence and this again was an executive over reach. The commission will resume on Friday with a new witness on the stand.
